ADVISORY WARNING
THE SUDAN AND SOUTH SUDAN (RESTRICTIVE MEASURES) (OVERSEAS TERRITORIES) ORDER 2012 [U.K.S.I. 2012 No. 361]
Tortola, British Virgin Islands – 5 July, 2012 – The British Virgin Island Financial Services Commission (the “FSC”) is advising the public of the publication of The Sudan and South Sudan (Restrictive Measures) (Overseas Territories) Order, 2012.
NOTICE IS HEREBY GIVEN that The Sudan (Restrictive Measures) (Overseas Territories) Order, 2004 (the “2004 Order”) has been revoked.
AND NOTICE IS FURTHER GIVEN that The Sudan and South Sudan (Restrictive Measures) (Overseas Territories) Order, 2012 (the “2012 Order”) gives effect to certain restrictive measures in respect of Sudan as adopted by the Council of the European Union in its Council Regulation (EC) No. 131/2004 which was initially adopted on 26 January, 2004, and came into force on 29 January, 2004. The 2012 Order updates the 2004 Order in respect of current events taking place in The Sudan and South Sudan.
The certain restrictive measures to be effected include a prohibition for any person to deliver or be involved in the supply or delivery of restricted goods to any person or destination in Sudan or South Sudan, except under the authority of a licence granted by the Governor. The prohibition extends to the exportation of restricted goods from the Territory to any destination in Sudan or South Sudan, except under the authority of a licence granted by the Governor. The restrictive measures further prohibit the provision of any technical assistance, brokering or other services, and financing or financial assistance in relation to military activities and restricted goods to any person in Sudan or South Sudan, again except under the authority of a licence granted by the Governor.
Restricted goods include military goods, and related software and technology as specified in Schedule 2 to the Export Control Order, 2008. The complete Schedule 2 can be accessed by using the following URL: http://www.legislation.gov.uk/uksi/2008/3231/contents/made
