Advisory Warnings

Tortola, British Virgin Islands – 5 July, 2012 – The British Virgin Island Financial Services Commission (the “FSC”) is advising the public, including all regulated and other persons, that they are required to comply with the requirements of The Al-Qaida and Taliban (United Nations Measures) (Overseas Territories) (Amendment) Notice, 2011.  

 

NOTICE IS HEREBY GIVEN that The Al-Qaida and Taliban (United Nations Measures) (Overseas Territories) Order, 2002 (U.K.S.I. 2002 No. 112) (the “Order”) has been amended by The Al-Qaida and Taliban (United Nations Measures) (Overseas Territories) (Amendment) Notice, 2011 (“the “Notice”). 

 

 The Order gave effect to measures adopted by the United Nations Security Council pursuant to UNSCR 1267 (1999), UNSCR 1333 (2000), UNSCR  1363 (2001), and UNSCR 1390 (2002), whereby any person who, except with the authority of a licence granted by the Governor, makes any funds available to or for the benefit of The Taliban, The Al-Qaida Organization, or Usama Bin Laden, or any entity or individual listed in the New Consolidated List, or any person acting on behalf of any such entity or individual is guilty of an offence.

 

The Notice amends the Order by giving effect to the further measures adopted by the United Nations Security Council pursuant to UNSCR 1989 (2011) by providing a revised list of persons and entities subject to sanctions under the earlier Resolution UNSCR 1390 (2002). Effectively, the United Nations Security Council Committee has revised the list of persons and entities subject to the assets freeze, travel ban, and arms embargo set out in paragraph 1 of the UNSCR 1989 (2011).  

 

NOTICE IS FURTHER GIVEN that the United Nations Security Council Committee has removed one entry from the Al-Qaida sanctions list. The Committee approved the deletion of the one entry specified below from its Consolidated List. The assets freeze, travel ban and arms embargo set out in paragraph 1 of UNSCR 1822 (2008) adopted under Chapter VII of the Charter of the United nations accordingly no longer apply to this entry.
