INTELLECTUAL PROPERTY RIGHTS PROTECTION FOR CLIENTS OF THORNTON SMITH ADVISORS LP
Road Town, Tortola – The BVI Financial Services Commission (the Commission) hereby informs current trade mark clients of Thornton Smith Advisors LP (the Partnership) that the Partnership is no longer authorised to act as a registered trade mark agent in the Territory of the Virgin Islands (the Territory).
It is a requirement of PART III, section 33(1) of the Trade Marks Act, 2013(the Act) that every application for the registration of a trade mark shall be effected by a registered trade mark agent whose functions are set out in section 35(1) of the Act and include inter alia acting as an intermediary between the trade mark owner and the Commission and the Registrari, filing applications to the Registrar, paying application fees and performing related duties on behalf of the trade mark owner.
In order to ensure that filings can be made and fees can be paid to the Registrar to preserve your trade mark registration, you may consider appointing a registered trade mark agent. A list of registered trade mark agents can be found on the Commission’s website here.
